Purchase rules

1. General provisions.
1.1. These Terms and Conditions of Sale and Purchase of Goods (hereinafter referred to as the “Terms and Conditions”) are a legal document binding on the parties, which sets out the rights and obligations of the Buyer and the Seller, the conditions for the purchase of the Goods and the conditions of payment for them, the procedure for delivery and return of the Goods, the liability of the parties and other provisions related to the purchase and sale of Goods in the online store “FaceMyo”.
1.2 By placing an order, the Buyer confirms his/her acceptance of these Terms and Conditions.
1.3 The contract between the Buyer and the Seller shall be deemed to have been concluded from the moment the Buyer has created a shopping cart in the online store, indicated the delivery address, chosen the payment method and read the Terms and Conditions, and clicked on the “Buy” button.

2. Personal data protection.
2.1 When ordering goods in the FaceMyo online store, the buyer must provide the data requested at the time of purchase: name, surname, address and e-mail address.
2.2 The Buyer is responsible for providing the correct data at the time of purchase.
2.3 By placing an order, the Buyer agrees to the processing of the personal data provided by him/her for the purpose of the order. The Buyer also consents to the sending of information notifications to the e-mail address provided by the Buyer, which are necessary for the execution of the order.
2.4 The Buyer’s personal data may be processed for marketing purposes only if the Buyer himself/herself consents to this.
2.5 The Seller undertakes not to disclose the Buyer’s personal data to third parties, except as required by a competent public authority in cases provided for by the laws of the Republic of Lithuania or with the Buyer’s separate written consent.

3. Buyer’s rights and obligations.
3.1 The Buyer undertakes to pay to the Seller the agreed amount for the goods ordered and to accept them.
3.2 Provide full, complete and correct information on the payment form. If the Buyer provides inaccurate, false or misleading information on the payment form, FaceMyo has the right to cancel the Buyer’s registration and delete the data.
3.2 In the event of a change in the Buyer’s data provided on the purchase form, the Buyer must immediately inform the Seller.
3.3 The Buyer shall have the right to withdraw from the contract of sale of the Goods in accordance with the provisions set out in the Return Policy.
3.4 By placing an order in the FaceMyo online store, the Buyer agrees to these Terms and Conditions of Sale and Purchase and undertakes to comply with them and with the provisions of the legislation of the Republic of Lithuania.

4. Seller’s rights and obligations.
4.1 The Seller undertakes to provide all the conditions for the Buyer to make proper use of the services provided by the FaceMyo online shop.
4.2 If the Buyer attempts to undermine the stability and security of the online shop or violates his/her obligations, the Seller has the right to restrict, suspend or terminate the Buyer’s access to the online shop immediately and without notice.
4.3 The Seller undertakes to respect the Buyer’s right to privacy with regard to the personal information belonging to the Buyer, as indicated in the purchase form, and not to disclose such information to any third party.
4.4 The Seller undertakes to deliver the goods ordered by the Buyer to the address indicated by the Buyer.
4.5 The Seller may, in the event of important circumstances, temporarily or permanently discontinue the operation of the Online Shop without prior notice to the Buyer.
4.6 The Seller may unilaterally change the terms of these Terms and Conditions.
4.7 If the Buyer uses the services provided by FaceMyo after the change of these Terms and Conditions, the Buyer shall be deemed to have accepted the change of the Terms and Conditions.

5. Ordering, prices, payment procedures, terms.
5.1.
5.2 Orders are only accepted through the FaceMyo Online Shop.
5.4. All prices of goods in the Online Shop are quoted in euros including VAT and in other currencies including VAT.
5.5 The Buyer undertakes to pay the order within 2 (two) calendar days from the date of order confirmation. The preparation of the parcel shall commence only upon receipt of payment for the goods.
5.6. Failure by the Buyer to make payment within 2 calendar days shall result in cancellation of the order.

6. Delivery of goods.
6.1 The Buyer undertakes to specify the exact place of delivery.
6.2 The Buyer undertakes to accept delivery of the goods himself. In the event that the Buyer is unable to take delivery of the Goods himself and the Goods are delivered to the address indicated, the Buyer shall not be entitled to make any claim against the Seller in respect of the delivery of the Goods to the wrong entity.
6.3 The Goods shall be dispatched to the Buyer within 5 working days of confirmation of payment.
6.4 In all cases, the Seller shall be exempt from liability for failure to meet the delivery deadlines if the goods are not delivered to the Buyer or are not delivered on time due to the Buyer’s fault or due to circumstances beyond the Seller’s control.
6.5 The Buyer shall immediately inform the Seller if the consignment is received in damaged packaging, if the consignment contains unsolicited goods or the incorrect quantity of the goods, or if the consignment is not fully assembled.6.6 The Buyer must provide the Seller with photographs of the damaged parcel and/or item(s) by email.

7. Product quality, guarantees.
7.1 All details of the goods sold in the FaceMyo online shop are set out in the description of each product.
7.2. The quantities of goods shown in the photographs in the shop do not always relate to the price of the goods – more than one item may be shown. The units of measurement are indicated in the description of the product. The colour of the goods may vary slightly depending on the monitor used by the Buyer.
7.3 The Seller may provide an appropriate quality guarantee for individual types of goods, the specific term and other conditions of which are set out in the product description.

8. Marketing and information.
8.1 The Seller may organise various promotions and offers in the FaceMyo online shop.8.2 The Seller has the right to unilaterally change the terms and conditions of promotions, as well as to cancel them without prior notice. Any modification or cancellation of the terms and conditions of the promotions shall be effective from the moment of the modification or cancellation.
8.3. The Seller shall send notifications to the Buyer to the email address specified in the Buyer’s purchase form.
8.4. The Buyer shall send all notifications and questions to the contacts specified in the “Contact” section of the Seller’s e-shop.
8.5 The Seller shall not be liable if the Buyer does not receive the information or confirmation messages sent due to disruptions in the internet connection, in the networks of the email service providers, if messages are sent to the SPAM directory, or due to the Buyer’s incorrectly provided data.
8.6 The Buyer’s personal data may be processed for marketing purposes under the conditions set out in Clause 2.4 of these Terms and Conditions.

9. Final provisions.
9.1 These Terms and Conditions of Sale and Purchase of Goods have been drawn up in accordance with the laws and regulations of the Republic of Lithuania.9.2 These Terms and Conditions are governed by the law of the Republic of Lithuania. All disagreements arising from the execution of these Rules shall be settled by negotiation. In the event of failure to reach an agreement, disagreements shall be settled in accordance with the procedure established by the laws of the Republic of Lithuania.
